TERMS AND CONDITIONS

Please take the time to read and understand the standard Terms and Conditions of booking set out below prior to booking a trip with MonTrails Tours Co.,Ltd.
 
  1. Contract
By contracting with MonTrails Tours Co.,Ltd. (referred to in these booking conditions as "we or us") you will be accepting these booking conditions on behalf of yourself and all other persons using our services pursuant to a booking made by you.
 
  1. Validity dates and itineraries are valid from 1st of January to 31st of December 2018.
 
  1. Child Policy
  • Child below 12 years old and sharing room with adults with no extra bed is free for the room only.  Maximum of 2 children in a room.
  • Child below 12, sharing room with adults and requiring extra bed pays extra bed or third person rate.
  • If room rate is inclusive of breakfast, child below 12 in the room pays for breakfast based on order or consumption.
 
  1. Deposit requirement
For individuals obliged to pay a non-refundable deposit of US$300 for your booking to be confirmed. For group booking a non-refundable deposit of US$400-800 required. Acceptance of your booking will be confirmed by us in written form. Payment of the balance of the trip price for individuals required 3 weeks, for groups is 30 days prior to travel. For bookings confirmed where the departure date is less than 3 weeks from the date confirmation received, we will require full payment immediately to confirm the booking. We accept payment by debit card, bank transfer and cash.
 
  1. Cancellation by the traveler
A cancellation will only be effective when we receive written confirmation of the cancel. On cancellation the charge per person will be:
  • 25-30 days prior to departure, we will retain the deposit;
  • 20-25 days prior to departure, we will retain the deposit or 35% of the total booking cost; whichever is greater, and
  • 15-20 days prior to departure, we will retain 50% of the total booking cost;
  • 10-15 days prior to departure, we will retain 75% of the total booking cost;
  • less than 10 days prior to departure, we will retain 100% paid by you in connection with the booking.
 
  1. Cancellation by MonTrails Tours
  • We may cancel a trip at any time up to 60 days before departure, subject to a lack of people in group departure. In case of fewer people than expected numbers, proper tariff is offered for consumers when the booking is not able to be canceled.
  • We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel a trip you may choose between us applying the amounts paid toward an alternative trip or receiving a full refund. We are not responsible for any incidental expenses that you may have incurred as a result of your booking such as visas, vaccinations or non-refundable flights.
 
  1. Change of price
The prices of MonTrails Tours trips are calculated at the dates of compilation. Certain modifications for the price can be made on following terms:
  • Increase in fuel or transportation price;
  • Change in exchange rate;
  • Other increase in official prices.
In case of above change in price, MonTrails Tours is authorized to adapt the price 3 weeks prior to departure. If the increase in price excess 10% of confirmed price by MonTrails Tours, you have the right to cancel the contract in 5 days after the reception of the notice.
 
  1. Booking amendments
  • If you wish to transfer from one trip to another or transfer your booking to a third party and notify us at least 30 days prior to the proposed departure date, it is free to change except for airline ticket or train ticket penalty.
  • If you notify us less than 30 days prior to the proposed departure date the refund policy applicable to cancellations will apply. Transfers to a third party are only permitted where the transferee meets all the requirements in relation to the trip, and transfers to another departure can only be made to a departure within the current validity period.
  • Amendments to any other arrangements made in conjunction with your trip will incur US$50 or 40EUR administration fee per booking per change. No amendments are permitted to your booking within 10 days of departure.
 
  1. Passport and visas
You must carry a valid passport and have obtained all of the appropriate visas, permits and certificates for the countries in which you will visit during your trip. Your passport must be valid for 6 months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct visas, permits and certificates for your trip. We are not responsible if you are refused entry to a country because you lack the correct passport, visa or other travel documentation.
 
  1. Travel Insurance
Travel insurance is compulsory for all MonTrails Tours travelers and should be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended coverage of US$10.000 for each of the heads of cover. We also strongly recommend you to get insurance in your country on cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide proof of your travel insurance on the first day of your trip; you will not be able to join the trip without it.
 
  1. Flexibility
You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.
 
  1. Change of Itinerary
While we endeavor to operate all trips as described we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary.
 
Before departure: If we make a major change we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative tour offered.
 
After departure: We reserve the right to change an itinerary after departure due to weather condition, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. In such emergency circumstances, the alternative itinerary will be offered by us in order to keep your satisfaction.
Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itinerary such as visas, vaccinations or non-refundable flights.
 
  1. Limitation of liability
We contract with a network of hotels, ger camps, government agencies and individuals to assist in the running of our trips as agent for these third parties. We are not responsible for the acts and omissions of these third parties. To the fullest extent permitted by law:
  • any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a trip, or any breach of the Booking Conditions, is excluded;
  • you release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip; and
  • any condition or warranty which would otherwise be implied by law into these Booking Conditions, is excluded.
 
  1. Authority on tour
Our trips are run by a travel expert guides who are well experienced. The decision of the travel expert is final on all matters likely to affect the safety or well-being of any person participating in the trip. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.
 
  1. Optional activities
Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance given by your tour guide or local representative in arranging optional activities does not render us liable for them.
 
  1. Check-in/Departures
It is your responsibility to leave ample time for your journey to the nominated departure point. Please ensure that you are at your stated departure point at least 15 minutes prior to the departure time. We cannot refund or rebook for your missing tours, trips or services as a result of delays on other transport services such as traffic, buses and/or railways.
 
  1. Alterations
If we must change your hotel or other details of the tour, which may be for reasons beyond our control, we will notify you as soon as possible and give you the information as to the alterations. If the change significantly alters an essential term of the contract, you will have the right to withdraw from the contract in which event we will repay all money already paid by you to us or the appropriate proportion if only some of the party withdraw. Alternatively you will have the option to:
a) Take a substitute tour of equivalent or superior value if we are able to offer you such a substitute;
b) Take a substitute tour of lower value if we are able to offer you one, when we will reimburse or allow you the difference in price of the tour contracted for and that of the substitute tour.
You undertake to let us know as quickly as possible your decision in the event of our having to advise you of any such alteration.
 
  1.  Force Majeure
Where we cancel the whole tour before departure because of unusual or unforeseen circumstances beyond our control, then we will refund all money already paid by you but you will not be entitled to any compensation for the loss of the tour. Where the tour is interrupted to a significant extent by circumstances beyond our control we will refund what is deemed to be a fair proportion of the cost of the tour.
 
  1.  Behavior
You will be responsible for the conduct of yourself and all members of your party and you will indemnify us against any liability for damage caused by you or any members of your party. We reserve the right to terminate the tour in the event of behavior deemed to be unreasonable by our staff.
 
  1.  Claims and Complaints
Should you have a complaint about your tour, contact your tour leader and our staff will do their best to rectify the matter. If we cannot resolve your complaint at the time then any further complaint should be put in writing to us at MonTrails Tours within 14 days of the end of the tour. We will not be able to deal with any complaints unless we are told in that way and by that time.
